An Interim Injunction was served on the County Council on 9 September 2009 to stop works on the site of the proposed Bus Rapid Transit (BRT) Phase 1 busway. The injunction was linked to an application for a judicial review of the County Council’s decision to grant planning permission for BRT Phase 1.
On Friday 18 September, following an application by Hampshire County Council and agreement between the parties, a High Court judge granted a variation to the conditions attached to the original injunction. This now allows the continuation of important preparatory and ecological works. These include the ongoing monitoring and maintaining of existing badger setts in accordance with Natural England’s guidelines, the relocation of reptiles and the installation of some temporary reptile fencing.
The variation will also allow the County Council to begin work to remove the disused and derelict railway track along the corridor, although this will not include sections in the vicinity of the badger setts, to ensure that they remain undisturbed.
The application by the claimant for permission to apply for judicial review and, if successful, the review itself will be heard on 14 and 15 October. As a result, the public information exhibition planned for 15-17 October will not go ahead. Hampshire County Council is continuing to vigorously contest the judicial review and firmly believes this scheme will bring much needed social, economic and environmental benefits to the wider local community.
